Rules and guidelines for using EaseNote

1. ACCEPTANCE OF TERMS

By downloading, installing, or using the EaseNote mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and BURNINGFLOWER INC ("we," "our," or "us").

2. DESCRIPTION OF SERVICE

EaseNote is a voice-to-notes application that:

  • Records audio through your device's microphone
  • Transcribes audio to text using OpenAI's Whisper API
  • Generates structured notes using OpenAI's GPT API
  • Stores audio and notes locally on your device

Key Features:

  • Voice recording and transcription
  • AI-powered note generation (summaries, key points, action items)
  • Local storage of all recordings and notes
  • Optional Google Sign-In for account management
  • Cloud-free audio storage (all audio stays on your device)

3. USER ACCOUNTS

3.1 Account Creation

You may use EaseNote without creating an account. If you choose to create an account:

  • You can sign in with Google (optional)
  • You must provide accurate information
  • You are responsible for maintaining account security
  • You must be at least 13 years old

3.2 Account Security

  • Keep your login credentials confidential
  • Notify us immediately of any unauthorized access
  • You are responsible for all activities under your account

4. USER CONTENT AND DATA

4.1 Your Content

You retain all ownership rights to:

  • Your voice recordings
  • Transcriptions generated from your recordings
  • Notes created by the App

4.2 License to Use

By using the App, you grant us a limited license to:

  • Process your audio recordings through OpenAI's APIs for transcription
  • Process transcribed text through OpenAI's APIs for note generation
  • Store your account information on our servers (if you create an account)

Important:

  • We do NOT store your audio recordings or notes on our servers
  • All audio and notes are stored locally on your device only
  • Data sent to OpenAI is automatically deleted after 30 days

4.4 Data Deletion

To delete individual notes:

  1. Tap a note on the home screen
  2. A popup window will appear
  3. Select "Delete" from the popup
  4. Confirm the deletion

Note: Deleted notes cannot be recovered.

To delete all data:

  • Notes must currently be deleted one by one
  • For complete account deletion, email [email protected]

5. PROHIBITED CONDUCT

You agree NOT to:

❌ Use the App for any illegal purpose
❌ Record conversations without proper consent (see Section 6)
❌ Upload or transmit malicious code or viruses
❌ Attempt to reverse engineer or hack the App
❌ Use the App to harass, abuse, or harm others
❌ Violate any applicable laws or regulations
❌ Share your account credentials with others
❌ Use the App if you are under 13 years old

6. RECORDING CONSENT AND LEGAL COMPLIANCE

6.1 Your Responsibility

YOU ARE SOLELY RESPONSIBLE FOR:

  • Obtaining necessary consent before recording any conversation
  • Complying with all applicable recording laws in your jurisdiction
  • Understanding and following "one-party" vs "two-party" consent laws

6.2 Recording Laws

Recording laws vary by location:

  • One-Party Consent: Some jurisdictions allow recording if one party (you) consents
  • Two-Party Consent: Other jurisdictions require ALL parties to consent before recording
  • Location-Specific Laws: Some places have additional restrictions

⚠️ WARNING: Recording conversations without required consent may be illegal in your jurisdiction. Violation of recording laws may result in criminal or civil liability.

6.3 Our Position

We provide a tool for recording and transcription. We:

  • Do NOT monitor what you record
  • Do NOT verify that you have obtained consent
  • Are NOT responsible for your compliance with recording laws
  • Disclaim all liability for your illegal use of recording features

You acknowledge and agree that you are solely responsible for legal compliance when recording.

7. THIRD-PARTY SERVICES

EaseNote integrates with the following third-party services:

7.1 OpenAI

  • Services Used: Whisper API (transcription), GPT API (note generation)
  • Data Shared: Audio files, transcribed text
  • Data Retention: Up to 30 days, then automatically deleted

7.2 Google Services

Google Sign-In (Optional)

  • Purpose: User authentication
  • Data Shared: Email, name, profile picture (with your consent)

Firebase Analytics (Anonymized)

  • Purpose: Usage analytics
  • Data Collected: Screen views, session duration, device type
  • Data: Anonymized, not linked to your identity
  • Privacy: https://firebase.google.com/support/privacy

Firebase Crashlytics

  • Purpose: Crash reporting and bug fixing
  • Data Collected: Crash logs, device info, app version
  • Privacy: https://firebase.google.com/support/privacy

7.3 Apple Services

  • Purpose: App distribution, payment processing
  • Data Shared: Subscription status
  • Terms: https://www.apple.com/legal/internet-services/itunes/

You agree to the terms of these third-party services when using features that rely on them.

8. SUBSCRIPTIONS AND PAYMENTS

8.1 Subscription Plans

EaseNote offers:

  • Free Plan: Limited recordings per month
  • Premium Plan: Unlimited recordings and features

8.2 Payment Terms

  • All payments are processed through Apple's App Store
  • Subscriptions automatically renew unless cancelled
  • Billing occurs through your Apple ID account
  • Prices are shown in the App and may vary by region

8.3 Cancellation

To cancel your subscription:

  1. Open Settings on your iOS device
  2. Tap your name → Subscriptions
  3. Select EaseNote
  4. Tap "Cancel Subscription"

Cancellation takes effect at the end of the current billing period.

8.4 Refunds

  • Refund requests must be made through Apple
  • We do not control Apple's refund policies

9. INTELLECTUAL PROPERTY

9.1 Our Rights

EaseNote and all related trademarks, logos, and content are owned by BURNINGFLOWER INC. You may not:

  • Copy, modify, or distribute the App
  • Remove copyright or trademark notices
  • Use our trademarks without permission

9.2 Your Rights

You retain all rights to your recordings, transcriptions, and notes.

10. AI-GENERATED CONTENT

10.1 Nature of AI Content

Notes generated by the App are created using AI (OpenAI's GPT models). This means:

  • Accuracy Not Guaranteed: AI may make errors, misinterpret context, or produce inaccurate summaries
  • No Warranty: We do not warrant the accuracy, completeness, or reliability of AI-generated content
  • User Responsibility: You must review and verify all AI-generated content

10.2 No Professional Advice

AI-generated content is NOT:

  • ❌ Legal advice
  • ❌ Medical advice
  • ❌ Financial advice
  • ❌ Professional consultation of any kind

Do not rely on AI-generated content for critical decisions without independent verification.

11. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy of transcriptions or AI-generated content
  • Uninterrupted or error-free operation

Use the App at your own risk.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall NOT be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from your violation of recording laws
  • Inaccuracies in transcriptions or AI-generated content
  • Unauthorized access to your device or data
  • Actions taken based on AI-generated content

Our total liability shall not exceed the amount you paid us in the past 12 months, or $100 USD, whichever is less.

13. INDEMNIFICATION

You agree to indemnify and hold harmless BURNINGFLOWER INC from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your violation of recording laws or privacy rights
  • Your violation of any third-party rights
  • Your use or misuse of the App

14. TERMINATION

14.1 By You

You may stop using the App at any time by:

  • Deleting the App from your device
  • Cancelling your subscription (if applicable)
  • Requesting account deletion at [email protected]

14.2 By Us

We may suspend or terminate your access if:

  • You violate these Terms
  • You engage in illegal activity
  • We are required to do so by law
  • We discontinue the App

14.3 Effect of Termination

Upon termination:

  • Your right to use the App ends immediately
  • Data stored locally on your device remains until you delete it
  • Subscription fees are non-refundable (subject to Apple's policies)

15. CHANGES TO TERMS

We may modify these Terms at any time. If we make material changes:

  • We will notify you through the App or via email
  • Continued use after changes constitutes acceptance
  • If you don't agree, stop using the App

Last modified date will be updated at the top of these Terms.

16. DISPUTE RESOLUTION

16.1 Informal Resolution

Before filing a claim, contact us at [email protected] to resolve the dispute informally. We will attempt to resolve within 30 days.

16.2 Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration, except where prohibited by law.

Arbitration Rules:

  • Conducted under American Arbitration Association (AAA) rules
  • Location: Delaware, USA (or mutually agreed location)
  • Arbitrator's decision is final and binding
  • Each party pays their own legal fees

16.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or representative proceeding.

16.4 Exceptions

Small claims court and claims related to intellectual property are exempt from arbitration.

17. GOVERNING LAW

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

18. INTERNATIONAL USE

EaseNote is based in the United States. If you use the App from outside the USA:

  • You are responsible for compliance with local laws
  • Your data may be processed in the United States
  • By using the App, you consent to this transfer

19. CHILDREN'S PRIVACY

EaseNote is not intended for children under 13. We do not knowingly collect data from children. If you believe a child has provided us with information, contact us immediately.

20. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

21. ENTIRE AGREEMENT

These Terms, along with our Privacy Policy, constitute the entire agreement between you and BURNINGFLOWER INC regarding the App.
